Felony

The Felony Trial Division is comprised of Assistant State's Attorneys who prosecute felonies in the two felony courtrooms. The Felony Trial Division is responsible for the prosecution of all felony cases. The LaSalle County State's Attorney's Office charges several hundred new felony cases each year, ranging from first-degree murder to theft.

Typically, a conviction on a felony charge carries a jail sentence of more than one year. For the more serious violent felonies, the sentences are significantly more, and many offenses carry mandatory minimum jail sentences.

The 5 classes of Illinois felonies are as follows:

Class X

  • Between 6 and 30 years in state penitentiary; and/or
  • Fine of up to $25,000
  • Examples: Aggravated Criminal Sexual Assault, Home Invasion

Class 1

  • Between 4 and 25 years in state penitentiary; and/or
  • Fine of up to $25,000
  • Examples: Criminal Sexual Assault, Residential Burglary

Class 2

  • Between 3 and 7 years in state penitentiary; and/or
  • Fine of up to $25,000
  • Examples: Arson, Burglary

Class 3

  • Between 2 and 5 years in state penitentiary; and/or
  • Fine of up to $25,000
  • Examples: Aggravated Battery, Forgery

Class 4

  • Between 1 and 3 years in state penitentiary; and/or
  • Fine of up to $25,000
  • Examples: Aggravated Assault, Stalking

Note: Sentences for murder convictions differ from other felony class sentences.
